What is Personal Information and why do we collect it?

This Personal Information is obtained in many ways including interviews, correspondence, by telephone, by email, via our website www.onpoint365.com.au and the onpoint 365 Payroll Portal, from your website, from media and publications, from other publicly available sources, and from third parties.

onpont 365 collect's your Personal Information for the primary purpose of providing our recruitment services to you, providing information to our clients. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our database at any time by contacting us in writing.

When onpoint 365 collects Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it. onpoint 365 collects personal information in a variety of ways including in forms or surveys filled out by you; when you register on our website or our mobile applications; in face-to-face meetings; in email, postal or social media correspondence; in telephone conversations; when you request information; or when you interact with our website, mobile applications, products, services, content or advertising. onpoint 365 collects most personal information directly from a person, but may also collect personal information from other third-party sources, for example:

  • When onpoint 365 receives results of tests and checks (such as a medical test, background check or criminal record check required for a role).
  • When onpoint 365 receives results of inquiries we might make of Candidates’ former employers, work colleagues, professional associations or registration body.
  • Information collected from the public domain.

Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.

Sensitive information will be used by us:

  • For the primary purpose for which it was obtained.
  • For a secondary purpose that is directly related to the primary purpose.
  • With your consent; or where required or authorised by law.

Your personal and sensitive information may be used for:

  • Potential and actual employers and clients of onpoint 365 and trusted third parties.
  • External providers used in providing our services to you (eg, on-line inductions and training providers, background checking agencies, criminal record, work rights, and credit checking).
  • Our assessment of your performance and prospects or any training needs.
  • Any test or assessment (including medical tests and assessments) that you might be required to undergo.
  • Any workplace assessment or rehabilitation.
  • Our management and resolution of any complaint, inquiry or investigation in which you are involved.
  • Any insurance claim or proposal that requires disclosure of your personal or sensitive information.
  • Undertaking checks to verify your work rights status, criminal history and any other background checks, including credit checks for positions involving significant financial risk and otherwise as permitted by law.
  • Where we have an appropriate processing agreement (or similar protections) in place providing us with specialised and efficient database management, development and storage who may be based in Europe.
  • Marketing technology platforms and suppliers who assist us with the provision of marketing communications to you, and customer feedback survey providers, such providers being based in the USA or Germany.
  • Third parties used by our clients as part of their recruitment, administration, screening and selection processes.
  • Third parties who assist us by developing services and processes to optimise and improve the quality and efficiency of recruitment services.
  • Third party contractors/service providers, job boards, job platforms, job aggregators, software providers and cloud-based databases for the purposes of assisting us to provide you with our services, and/or to improve the services we offer you. Such service providers/contractors may be based outside of Australia and New Zealand, including the USA and Canada.
  • Our insurers.
  • A Workers Compensation body.
  • Any person with a lawful entitlement to obtain the information.


If you do not give us the information we seek

  • onpoint 365 may be limited in our ability to locate suitable work for you; and
  • onpoint 365 may be limited in our ability to place you in work.


Security of Personal Information

Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorized access, modification or disclosure.

When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years.


Access to your Personal Information

You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing.

In order to protect your Personal Information we may require identification from you before releasing the requested information.


Maintaining the Quality of your Personal Information

It is an important to us that your Personal Information is up to date. We will take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date.
